Terms and Conditions for WallFrame

Please read these Terms and Conditions (“Terms”) carefully before using WallFrame.
1. Introduction
These Terms of Use (“Terms”) govern your access to and use of WallFrame, a mobile application provided by Sciclear Corporation, a Wyoming Corporation, located at 30 N Gould Street, STE N, Sheridan, WY 82801 (“Company”, “we”, “us”, or “our”). By using the WallFrame app or any related services, you agree to these Terms and our Privacy Policy.
You must be at least 18 years old to use this Service. If you do not agree to these Terms, do not use WallFrame.
2. Definitions
Application: The WallFrame mobile app.
Content: Any text, image, or material you upload or generate through the Service.
Device: A mobile phone, tablet, or similar hardware capable of running the Application.
In-App Purchases (IAP): Optional purchases made within the app.
Service: WallFrame and any related sites or services.
Subscription: Paid, auto-renewing access to premium features.
You: The individual using the app, or the entity they represent.
3. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and all activity under your account. We reserve the right to suspend or terminate your account for violations of these Terms.
4. Subscriptions & Billing
Recurring Billing: Subscriptions renew automatically unless canceled via your App Store settings.
Cancellation: Cancel through your Apple ID at any time; access continues until the end of the billing cycle.
Refunds: All fees are non-refundable except as required by law or App Store policies.
Fee Changes: We may adjust pricing with notice. Continued use constitutes acceptance.
5. In-App Purchases & Free Trials
We may offer in-app purchases including exports, tools, or visual assets.
IAPs are non-transferable and not redeemable for cash.
Free trials convert to paid plans unless canceled in time.
All purchases and refunds are managed by the App Store provider.
6. User Content & Licenses
You retain rights to your uploaded content but grant us a limited license to use it as needed to operate the Service. You confirm you have the rights to upload and share such content.
Prohibited Content: Do not upload anything illegal, harmful, or infringing. We reserve the right to remove content violating this rule.
7. Intellectual Property
All WallFrame content (excluding your uploads)—including software, designs, room templates, and UI elements—is owned by the Company or licensors and protected under intellectual property laws. You may not reuse or distribute these elements.
8. App Functionality Limitations
Measurement Disclaimer: WallFrame estimates measurements based on your input and device data. It is not a professional tool.
Color & Display: On-screen previews may differ from physical prints or artwork.
Export Restrictions: Free users may face limits on exports or watermarks. Premium removes many restrictions.
Prohibited Use: No reverse-engineering, scraping, or misuse of licensed assets.
9. Feedback
Any ideas or feedback you submit may be used by us without obligation or compensation.
10. Third-Party Services
WallFrame may integrate with third-party platforms (e.g., Apple Photos, iCloud). Their terms govern your use of those services.
11. DMCA Policy
We respect the intellectual property rights of others. If you believe your copyright has been infringed, you may send a notice under the Digital Millennium Copyright Act (DMCA) to:

Subject: DMCA Notice
Your notice must include:
A physical or electronic signature of the copyright owner or agent;
Description of the copyrighted work;
Description of where the infringing material is located;
Your contact information;
A statement that you have a good faith belief that use is unauthorized;
A statement under penalty of perjury that the information in your notice is accurate.
We may remove infringing content and may terminate repeat infringers’ accounts.
12. Privacy & Data Compliance
We process your personal data in accordance with our Privacy Policy.
Wyoming Users: In case of a data breach involving your personal information, we will notify you in accordance with W.S. § 40-12-501 et seq.
California Residents (CCPA): You have the right to access, delete, and control your personal information as defined under the California Consumer Privacy Act (CCPA).
EU Residents (GDPR): If you reside in the European Union, your rights under the General Data Protection Regulation (GDPR) are respected, including the right to be forgotten and to access your data.

13. Termination
We may suspend or terminate access for any reason, including violations of these Terms. Upon termination, you must stop using the Service.
14. Disclaimers and Limitation of Liability
WallFrame is provided “AS IS” without warranties of any kind.
We are not liable for indirect or consequential damages, and our total liability is limited to $100 or the amount paid in the last 12 months.
Some jurisdictions may not allow such exclusions; in that case, our liability is limited to the maximum allowed by law.
15. Governing Law
These Terms are governed by the laws of the State of Wyoming, without regard to conflict of law rules. You consent to the exclusive jurisdiction of the state or federal courts located in Sheridan County, Wyoming.
16. Miscellaneous
Severability: If any provision is found invalid, the rest remain enforceable.
Waiver: Failure to enforce a right does not waive it.
Changes: We may update these Terms. Material changes will be announced in-app. Continued use means acceptance.
Translation: If provided in other languages, the English version controls.
